A prenuptial agreement or ‘ prenup’ is made before entering into a marriage or registering a civil partnership. The agreement seeks to set out in the event of the marriage/ civil partnership breaking down what should happen to your finances, e.g., property division, lump sum and/or maintenance payable to you, your partner, or any children. Regrettably such an agreement is not currently one hundred percent legally binding. The court still has power to order different financial provisions to those set out and previously agreed in the agreement. However, such prenuptial agreements are being given much more weight by the courts today and EPO lawyers may recommend them in certain circumstances as opposed to not entering into such agreement.
